Terms of Service

1. Introduction

Welcome to Doodle ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the Doodle website at doodle.co.ke, the customer mobile application, the driver mobile application, the merchant portal and all related services (collectively the "Platform").

By creating an account or using the Platform you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement under the laws of Kenya.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorised access. Doodle is not liable for losses arising from your failure to secure your account.

4. Orders and payments

All prices displayed on the Platform are in Kenya Shillings (KES) and include any applicable VAT. A delivery fee, service fee and any applicable surge charge are shown before you confirm your order. Payment is processed via M-Pesa or other payment methods we make available from time to time.

An order is accepted once has confirmed payment. We reserve the right to cancel an order if the merchant is unable to fulfil it, in which case a full refund will be issued.

5. Cancellations and refunds

If you cancel an order before the merchant begins preparation you will receive a full refund. If the merchant has already started preparing your order, a partial refund may apply. Orders that are already in transit cannot be cancelled by the customer.

6. Merchant obligations

Merchants on the Platform are independent businesses. Doodle does not prepare, cook or handle any food or goods. Merchants are responsible for food safety, accurate menu descriptions and compliance with all applicable Kenyan food and health regulations.

7. Driver obligations

Delivery riders using the Platform must maintain a valid driving permit (for motorised vehicles), personal accident insurance, and comply with all traffic laws. Gig drivers are independent contractors, not employees of Doodle.

8. Intellectual property

All content on the Platform — including logos, text, graphics, software and algorithms — is the property of Doodle or its licensors and protected by Kenyan and international intellectual property laws. You may not copy, modify or distribute any part of the Platform without written permission.

9. Limitation of liability

To the maximum extent permitted by law, Doodle shall not be liable for indirect, incidental, special, consequential or punitive damages arising from your use of the Platform. Our total liability for any claim shall not exceed the amount you paid for the specific order that gave rise to the claim.

10. Governing law

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes shall be resolved by the courts in Nairobi, Kenya.

11. Changes to these terms

We may update these Terms from time to time. If we make material changes we will notify you via the Platform or by email. Your continued use of the Platform after notification constitutes acceptance of the updated Terms.
